Question: Why is it not permissible to accept news of the moon from neighbouring countries? Do territorial boundaries affect the Shariah’s ruling on the issue of the hilaal?

Answer: Many people are quite-rightly querying this issue. There is no Shar’i barrier for accepting news of hilaal confirmation from neighbouring countries according to the Hanafi Math-hab. However, it is not permissible for Shaafis.

Regarding hilaal sightings of neighbouring countries, the only reason why we are not accepting such information/news is because we have no link with reliable persons in these countries. There is no Shar’i barrier or prohibition for accepting hilaal news from the neighbouring countries. The condition for accepting is that the news must reach us by Tareeq-e-Moojib. If we can establish a reliable link, then accepting news from the neighbouring countries will be permissible.

Komatipoort is only 90 km from Maputo. It is illogic that this town can accept moon news from Cape Town which is 1800 km away, but cannot receive news from 90 km away. Geographical boundaries have no bearing. The fundamental issue is that there has to be certitude regarding the news.

If the Muslims of Komatipoort who may be having reliable links in Maputo, accept the hilaal confirmation of Maputo and have Eid while the rest of South will not be having Eid due to no sighting being confirmed, then the Komatipoort community will be within their rights to celebrate Eid. It will be improper and not permissible to pressurize the Komatipoort Muslims to follow Durban or Cape Town and to reject Maputo which is a mere 90 km from them.

However, just as Shaafis in Cape Town or anywhere else in the country may not accept  moon news from Johannesburg, Durban, Port Elizabeth and not even from Mosselbay, so too, to a greater degree may they not accept the sightings of neighbouring countries. Since this is the ruling of the Shaafi Math-hab, it is incumbent for Shaafis to follow the ruling of their Math-hab, not the ruling of the fong kong, munaafiq juhala of the MJC.

Although, due to the Shaafi Math-hab’s ruling, there will generally be Eid on different days for Hanafis and Shaafis, it matters not. What matters is the Shariah. The Shaafi Math-hab is the Shariah for Shaafis, hence it is Waajib that they submit and follow the rulings of Imaam Shaafi (Rahmatullah alayh) regardless of the different day the Hanafis may be celebrating Eid or starting Ramadhaan.

This difference is valid and following it is binding on Shaafis in terms of the Shariah. Any Hanafi who disputes this issue on the basis of a false ‘unity’ concept whispered into his heart by Iblees is a moron – a jaahil who is ignorant of the Shariah as are these MJC hybrid sheikhs-molvis as well as the members of Bogus uucsa, and the illegitimate NNB jamiat clique under Reverend Abraham Bham.

The unity of Muslims is not in fiction – the fiction of having Eid on the same day in violation of the Shariah. The unity – true unity – of Muslims is in obedience and submission to the Deen. ‘Unity’ on false premises is baatil and a shaitaani snare. The unity which the Qur’aan commands, is Unity based on the Shariah. Thus, Allah Ta’ala states in the Qur’aan Majeed:

“O People of Imaan! Fear Allah as you should fear Him, and do not die except as Muslims. And hold on firmly to the Rope of Allah, and do not split up. And remember the favour of Allah on you when you were enemies, then He created love in your hearts for one another. Thus, with His favour you became brothers. You were (in reality) on the brink of the pit of fire, then He saved you from it. In this manner does Allah explain to you His Aayaat (Signs and Laws) so that you attain hidaayat (guidance).

The unity commanded is on the basis of Hablullaah (the Rope of Allah – His Shariah). Unity on the basis of shaitaan’s whisperings and inspiration is satanism. The consequences of this type of satanic ‘unity’ which creates greater disunity, is concealment and suppression of the Haqq just as the Bogus uucsa characters are notorious for. They suppress hilaal confirmation news in Johannesburg, Durban, etc. until they receive permission from their evil MJC counterparts and also from the Qabar Pujaaris jamiats.

Even if they are 100% certain of confirmed sightings, the news is suppressed because the bogus characters in Cape Town are still awaiting the sun to set. Only when the juhala and Zanaadaqah of the MJC make a determination, are their counterparts in Johannesburg and Durban allowed to make any announcement.  Those guilty of the heinous crime of Kitmaanul Haqq (Concealment and suppression of the Haqq) are the NNB jamiat molvis and the Jamiatul Ulama KZN molvis. They are members of bogus uucsa, hence their brains and tongues are welded to baatil which spawns kitmaanul haqq.
